Condition 8503: Known as “No Further Stay,” it prevents visa holders from applying for any substantive visas other than a protection visa while in Australia.

Condition 8534 and 8535: Similar to 8503, with exceptions allowing applications for specific visas like the Temporary Graduate visa or Student Guardian visas under certain conditions.

Condition 8540: Specific to certain visa subclasses like the Work and Holiday visa, it allows applications only for a protection visa or another similar subclass.

Waiving the Conditions

Waivers for these conditions can be requested if after the visa grant, compelling and compassionate circumstances that were beyond the visa holder’s control arise, causing a significant change in their circumstances. These circumstances could include:

– Travel Restrictions: Such as during a pandemic, which might prevent a visa holder from leaving Australia as planned.

– Unfit to Travel: Due to severe medical conditions or injuries that occur in Australia, making it unreasonable for the visa holder to travel.

– Family Emergencies: Like the death or serious illness of a close family member in Australia, requiring the visa holder’s presence and support.

– Natural Disasters or Severe Unrest: In the visa holder’s home country, making it unsafe or unreasonable to return.

– Educational Disruptions: Such as the closure of an educational provider, impacting the visa holder’s study plans.

– Government Support: Where a visa holder is sponsored by a government for a specific program and continuation in Australia is essential.

When you apply for certain skilled visas, the act of applying itself is considered sufficient to waive these conditions. This means you don’t have to make a separate request to remove or waive the “No Further Application” condition—it’s automatically considered due to the nature of your application.

However, if you have an ongoing application for a Subclass 482 visa, you can still apply for a Subclass 187 visa without waiting for the Subclass 482 visa to be granted.
